- Under the Federal Alcohol Administration Act, to be considered a malt beverage, a product must be made from a base that is 25% malt and must contain at least 7.5 pounds of hops per 100 barrels of finished product.
- Formula approval by the Alcohol and Tobacco Tax and Trade Bureau is required if the brewer of a malt beverage uses flavors with alcohol, compounded flavors, colors, artificial sweetners, other agricultural ingredients, or if the beverage is frozen.
- If a beer or malt beverage contains more than 6% ABV, no more than 1.5% of the finished product may consist of alcohol derived from flavorings and other non-beverage ingredients, in order to remain in the malt beverage category.
